MoD: No prosecutions under AFSPA

Defense Minister Manohar Parrikar told Parliament earlier this week that the defense ministry has not, so far, sanctioned any prosecution under the Armed Forces Special Powers Act (AFSPA), having received 38 requests for prosecution since June 1991.

In response to a question from the MP Avinash Pande in the Rajya Sabha, Parrikar said, “Total thirty eight (38) requests for sanction of prosecution have been received under Armed Forces (Special Powers) Act (from 16.06.1991 to till date).”

“Out of 38 cases received, sanction has been denied in 30 cases and 8 cases are still pending,” added Parrikar in his statement.

Permissions for six cases from Jammu and Kashmir and two cases from Assam remain undecided. The most recent of these cases is from Assam in 2010. The most recent pending case from Jammu and Kashmir dates to the year 2000.
